1. Acceptance of Terms

By accessing or using HeadshotCraft ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

HeadshotCraft is an AI-powered professional headshot generation service. You upload photos, and our AI generates professional-quality headshots based on your input.

3. Eligibility

You must be at least 16 years old to use the Service. By using HeadshotCraft, you represent that you meet this requirement.

4. Account Registration

• You register via Google OAuth through Clerk.
• You are responsible for maintaining the security of your account.
• You must provide accurate information and keep it updated.
• One person, one account. Shared accounts are not permitted.

5. Subscriptions & Payment

5.1 Plans

5.2 Billing

• Payments are processed by Stripe.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Prices are in USD. Applicable taxes may apply based on your jurisdiction.

5.3 Cancellation

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period.
• You retain access to the Service until the end of your paid period.

6. Acceptable Use

6.1 You May

• Upload your own photos or photos for which you have explicit consent from the subject.
• Use generated headshots for personal, professional, or commercial purposes (e.g., LinkedIn, resumes, company profiles).

6.2 You May NOT

• Upload photos of others without their consent.
• Upload photos of minors.
• Use the Service to create deceptive, fraudulent, or misleading content (e.g., fake identities, impersonation).
• Use generated images for illegal purposes.
• Attempt to reverse-engineer, exploit, or attack the Service.
• Resell access to the Service or generated headshots as a competing service.
• Use the Service to generate explicit, violent, hateful, or otherwise harmful content.
• Circumvent usage limits or access controls.

6.3 Enforcement

We reserve the right to suspend or terminate accounts that violate these Terms, without refund.

7. Intellectual Property

7.1 Your Content

• You retain ownership of the original photos you upload.
• You grant us a limited, non-exclusive license to process your photos solely for providing the Service.
• This license terminates when your photos are deleted.

7.2 Generated Headshots

• You own the generated headshots created from your uploads.
• You may use them freely for personal and commercial purposes.
• We do not claim ownership of your generated headshots.

7.3 Our Service

• The HeadshotCraft platform, branding, software, and AI models are owned by Nextfield Labs LLC.
• These Terms do not grant you any rights to our intellectual property beyond using the Service as intended.

8. AI-Generated Content Disclaimer

• AI-generated headshots are approximations and may not perfectly represent your appearance.
• Results vary based on input photo quality, lighting, and other factors.
• HeadshotCraft does not guarantee specific results or likeness accuracy.
• You are responsible for reviewing generated headshots before use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
• Nextfield Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Nextfield Labs LLC from any claims, damages, or expenses arising from:

• Your violation of these Terms.
• Your uploaded content (including using photos without consent).
• Your use of generated headshots.

11. Privacy

Your use of the Service is also governed by our Privacy Policy.

12. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email or website notice at least 14 days in advance. Continued use after changes take effect constitutes acceptance.

13. Termination

• By you: Cancel your subscription and delete your account at any time.
• By us: We may suspend or terminate your account for Terms violations or at our discretion with reasonable notice.
• Upon termination, your data will be handled per our Privacy Policy (deleted within 30 days).

14. Governing Law & Disputes

• These Terms are governed by the laws of the State of Wyoming, USA.
• Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English.
• You waive any right to participate in class action lawsuits or class-wide arbitration.
• Small claims court actions are permitted.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Nextfield Labs LLC regarding the Service.
